1. Data Controller
The data controller for personal data collected through this website is the owner identified in the Legal Notice, section 1.
2. Purposes and Legal Basis of Processing
- Manage orders and formalize the sales contract — legal basis: contract performance.
- Address inquiries, incidents, and return requests — legal basis: contract performance and legitimate interest.
- Send commercial communications about new drops and updates — legal basis: express consent, revocable at any time.
- Comply with tax and accounting obligations — legal basis: legal obligation.
- Analyze website usage to improve it — legal basis: consent, through analytical cookies configured in the privacy banner.
3. Categories of Data Processed
- Identification data: first and last names.
- Contact data: email, phone, shipping, and billing address.
- Order and payment data: purchase history; payment data is processed directly by Shopify Payments, Stripe, or PayPal, without Templary Wear storing full card details.
- Browsing data: IP address, device type, and cookies (see Cookie Policy).
4. Recipients and Data Processors
To provide the service, Templary Wear shares strictly necessary data with the following data processors:
- Shopify Inc. — hosting platform, online store management, and order processing.
- Stripe and PayPal — payment gateways.
- Shipping and logistics companies — for order delivery.
- Email marketing tools that may be contracted in the future, as the Marketing and Launch Plan evolves.
Templary Wear does not sell or transfer personal data to third parties for purposes other than those described in this document.
5. International Data Transfers
Shopify processes data initially in Ireland (European Union) and may transfer it to its facilities in the United States and Canada for service provision. According to public information from Shopify, these transfers are covered by the EU-US Data Privacy Framework and/or standard contractual clauses approved by the European Commission.
Current note (July 2026): The EU-US Data Privacy Framework is experiencing a period of legal uncertainty, following a US Supreme Court ruling (Trump v. Slaughter) that questions the independence of the Federal Trade Commission, and in light of ongoing litigation filed by activist Max Schrems (noyb). It is recommended to periodically review the status of the framework and confirm with Shopify that the data processing agreement (DPA) includes standard contractual clauses as an additional safeguard.
6. Retention Period
Data is retained as long as there is a contractual relationship with the user and, subsequently, for the applicable legal periods (generally, 6 years for tax and accounting documentation in accordance with the Commercial Code, without prejudice to specific tax periods). Data processed for marketing purposes is retained until consent is revoked.
7. User Rights
Users can exercise their rights of access, rectification, erasure, objection, restriction of processing, and data portability by writing to hola@templarywear.com. They also have the right to file a complaint with the Spanish Data Protection Agency (AEPD) if they believe their data is not being processed in accordance with regulations.
8. Minors
This site is not directed at minors under 14 years of age, the minimum age for digital consent according to the LOPDGDD in Spain. If data of a minor under that age is detected without the consent of their legal guardian, Templary Wear will proceed to delete it.
9. Data Security
Templary Wear relies on the technical and organizational measures provided by Shopify (data encryption, compliance with PCI DSS standard for payment processing) and applies additional internal measures for accessing the store's management panels.
10. Data Protection Officer / Privacy Contact
Given the volume and current nature of data processing, it is not mandatory for Templary Wear to appoint a Data Protection Officer in accordance with Article 37 of the GDPR. Any privacy-related query can be directed to the contact email.
11. Changes to this Policy
Templary Wear may modify this document at any time. The applicable version is the one published on the website at any given time.
